Indemnity

You agree to defend, indemnify and hold Greg Costa and Greg Costa’s officers, directors, employees, agents and licensors harmless from all judgments, awards, losses, liabilities, costs and expenses, including but not limited to reasonable attorney’s fees, expert witness fees, and costs of litigation arising out of or based on (a) Content you submit, post to or transmit through the Site, (b) your use of the Site, (c) your connection to the Site, (d) your violation of the TOS or (e) your violation of any rights of a third party.

Pricing, Shipping, and Terms of Sale

Prices for products are described on the Site and are incorporated into this TOS by reference. All prices are in US dollars. Prices and products may change at Greg Costa’s discretion. Greg Costa may offer promotional discounts from time-to-time. You must agree to the terms of the promotion in order to be given the discount. You agree not to use more than one discount per item, unless such use is expressly permitted by Greg Costa. Title and risk of loss for all products ordered by you shall pass to you on Greg Costa shipment to the shipping carrier. If you are not satisfied with your product for any reason, you may notify us and receive a replacement, refund or account credit within 30 days of receipt. As Greg Costa launches new products, it will update the Returns information as necessary.

Dispute Resolution and Release

These terms and conditions and your relationship with Greg Costa shall be governed by and construed in accordance with the laws of the state of California, without resort to its conflict of law provisions. Any dispute relating in any way to your visit to the Site or to the products you purchase through the Site shall be submitted to confidential binding arbitration in Los Angeles, California for the maximum judgment enforceable, except that to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in the State of California. You hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non convenes with respect to venue and jurisdiction in the state and federal courts of California. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. You and Greg Costa agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Los Angeles California.

If you have a dispute with one or more users or Fundraisers you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

Severability

If any provision of this TOS is invalid, illegal or unenforceable under any applicable statute or rule of law, such provision shall be deemed amended to achieve as nearly as possible the same economic effect as the original provision and the remaining provisions of this TOS shall in no way be affected or impaired.

General

  • No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this TOS.
  • Greg Costa may assign its rights and responsibilities hereunder without notice to you.
  • These terms and conditions will inure to the benefit of Greg Costa’s successors, assigns and licensees.
  • Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof.
  • The failure of a party to exercise or enforce any right or provision of this TOS will not constitute a waiver of the right or provision.
  • Greg Costa failure to act with respect to a breach by you or others does not waive Greg Costa’s right to act with respect to subsequent or similar breaches.
  • This TOS, the Privacy Policy, and the Shipping and Returns Policy constitute the entire agreement between you and Greg Costa, and supersedes all other communications, written or oral, with regard to the subject matter herein, our site and services provided by Greg Costa.

In no way Does Greg Costa replace or Is a Doctor, Lawyer or Lisense Mental Health, or Licensed Social worker, or  Counselor.  Again He is a survivor and serves as mentor for other TBI surviors, their families, and caregivers offering knowledge solely based on his own recognizance.. It is by your own free will you seek the advice and guidance of Mr. Costa. He urges you to become your own advocate so you can better your personal journey in creating the best support system and network that is right for you.

WHAT IS PARTNERS? The Partners in Policy making Leadership Institute is a leadership, advocacy and self-advocacy training program for adults with disabilities and family members of persons with disabilities from across the state, sponsored by the Tennessee Council on Developmental Disabilities.

 He Also attends The Self-Advocacy Leadership Academy Training which includes:
